Terms and Conditions

The serious stuff. No smoke. No mirrors. Just the rules we both play by.

Welcome to Energy PUNK.

These Terms & Conditions explain the basis on which you may use the Energy PUNK website, learning platform, membership services, courses, digital resources and associated content.

By creating an account, purchasing membership or accessing paid Energy PUNK content, you agree to these Terms & Conditions.

Energy PUNK is operated by Energy PUNK Ltd, a company registered in Scotland.

Company number: SC861723

Throughout these Terms, references to Energy PUNK, we, us or our mean Energy PUNK Ltd.

2. What Energy PUNK provides

Energy PUNK provides online education, technical learning and professional development, primarily for people working within the heating, building services and low-carbon energy sectors.

Membership may include access to:

Online learning modules
Videos and animations
Interactive learning activities
Downloadable learning materials
Technical guides and manuals
Calculators, simulators and digital tools
Live webinars and online sessions
Community areas
Certificates of completion
New and updated learning content
Other resources introduced as the platform develops

The exact content included within membership may change as Energy PUNK develops, improves and updates the platform.

3. Membership

Unless otherwise stated at the point of purchase, Energy PUNK membership costs:

£60 per month

Membership is subject to an:

Initial minimum commitment of three months

The minimum financial commitment is therefore £180.

Payments will normally be collected monthly using the payment method selected during checkout.

After the initial three-month minimum period, membership will continue on a monthly rolling basis unless cancelled.

During the initial three-month period

You may request cancellation at any time. However, unless a statutory cancellation right applies, cancelling your membership does not remove your obligation to pay any remaining charges due within the initial three-month minimum commitment.

After the initial three-month period

Your membership becomes a monthly rolling subscription and may be cancelled in accordance with Section 6.

4. Automatic renewal

Following the initial three-month commitment, your membership will automatically continue on a monthly basis.

The recurring nature of the subscription, price and minimum commitment will be displayed before purchase.

Where required by applicable law, Energy PUNK may provide additional subscription information, renewal reminders or notices before future payments.

We will provide a reasonable and straightforward method for cancelling a subscription.

5. Your right to cancel

Depending on the nature of the product or service purchased, UK consumer law may provide a statutory cancellation period.

Energy PUNK provides digital learning content that can normally be accessed immediately after purchase.

Where you specifically request immediate access to digital content, you may be asked during checkout to confirm that:

You wish the supply of digital content to begin immediately; and
You understand that beginning supply may affect any statutory cancellation rights that would otherwise apply.

Nothing in these Terms removes or limits any statutory rights that cannot legally be excluded.

6. How to cancel your membership

You may cancel your membership:

Through your Energy PUNK account, where an online cancellation option is provided; or
By emailing info@energypunk.net

We will confirm cancellation by email.

Following completion of the initial three-month minimum commitment, cancellation will normally take effect at the end of the membership period already paid for.

No further recurring membership payment will then be taken.

You will normally retain access until the effective cancellation date.

Where legislation requires a different cancellation process, notice period, reminder or cooling-off arrangement, Energy PUNK will comply with those requirements.

7. Refunds

Payments already made are generally non-refundable where:

Membership access has been correctly provided
Digital content has already been accessed
No statutory cancellation or refund right applies
Energy PUNK has not materially failed to provide the service purchased

This does not affect your statutory rights.

Where you have a legal entitlement to a refund, Energy PUNK will provide that refund in accordance with applicable consumer law.

8. Subscription law and future regulatory changes

Subscription and consumer protection legislation may change from time to time.

Energy PUNK may update its membership, renewal, reminder, cooling-off and cancellation processes where necessary to comply with applicable UK law.

Where a legal or regulatory change materially affects an existing membership, we will take reasonable steps to explain the change to affected members.

9. Your account

Your Energy PUNK account is personal to you.

You must:

Provide accurate registration information
Keep your login credentials secure
Not deliberately allow another person to use your account
Notify us if you believe your account has been compromised
Use the platform only for lawful purposes

Unless expressly agreed otherwise, membership is licensed for use by one individual learner.

10. Account sharing

Energy PUNK membership must not be:

Shared between multiple individuals
Resold
Transferred
Made available to another business or organisation
Used to provide unauthorised group training
Used to systematically reproduce Energy PUNK materials

We may use reasonable technical measures to identify unusual account activity, including simultaneous or excessive login activity.

Where we reasonably believe an account is being shared or misused, we may contact the account holder, temporarily restrict access or suspend the account while the matter is investigated.

13. Educational information and professional responsibility

Energy PUNK provides education, technical learning and professional development.

Our content does not replace:

Legislation
Manufacturer instructions
Approved codes of practice
Current British Standards
Industry guidance
Site-specific risk assessment
Competent professional judgement
Any licence, certification or qualification legally required to undertake work

Learners remain responsible for ensuring that work they undertake complies with current legal, regulatory, technical and manufacturer requirements.

14. Accuracy of technical content

We take reasonable care to ensure Energy PUNK learning content is accurate and current at the date of publication.

However, the heating, building services and low-carbon sectors are subject to changes in:

Legislation
Standards
Technical guidance
Manufacturer requirements
Technology
Industry practice

We may therefore update, replace or withdraw learning content where necessary.

Where an error is identified, we will aim to correct it within a reasonable period.

15. Course progression

Energy PUNK may recommend a particular learning sequence or pace.

Some modules may build upon knowledge introduced in earlier modules.

We may therefore require completion of certain activities before later material becomes available.

Recommended completion times are guidance unless a particular course states otherwise.

16. Assessments

Some Energy PUNK courses may include:

Knowledge checks
Quizzes
Exercises
Assignments
Assessments
Other evaluation activities

Learners must complete assessment activities themselves unless collaboration is expressly permitted.

Submitting work completed by someone else, using another learner's account or deliberately misrepresenting your own work may result in assessment results being cancelled or account access being suspended.

17. Certificates of completion

Energy PUNK may issue digital certificates when specified learning requirements have been completed.

Unless expressly stated otherwise, an Energy PUNK certificate of completion:

Is not an Ofqual-regulated qualification
Does not confer professional registration
Does not by itself demonstrate occupational competence
Must not be represented as an externally accredited qualification
18. Awarding-body and externally approved programmes

Some Energy PUNK programmes may be approved, accredited or awarded by an external awarding or certification organisation.

Where this applies, it will be expressly identified on the relevant course or qualification page.

Additional requirements may apply, including:

Entry requirements
Identity verification
Assessment requirements
Certification arrangements
Appeals procedures
Quality assurance requirements
Awarding-body rules

The presence of an awarding-body logo on the Energy PUNK website does not mean that every Energy PUNK course, module or membership product is accredited or approved by that organisation.

19. Live sessions and webinars

Membership may include live online learning sessions.

Dates, presenters and topics may occasionally change.

Where reasonably possible, we will provide notice of significant changes.

Unless expressly guaranteed as part of a particular purchased product, failure to attend a live session does not normally entitle a learner to a refund.

Where recordings are provided, their availability period may vary.

20. Community areas

Where Energy PUNK provides forums, groups or community features, users must communicate professionally and respectfully.

You must not post material that is:

Unlawful
Threatening
Abusive
Discriminatory
Defamatory
Deliberately misleading
Commercial spam
Infringing of another person's intellectual property
Otherwise likely to harm the community or platform

We may remove content or restrict community access where reasonably necessary.

21. Platform availability

We aim to provide reliable access to Energy PUNK.

However, uninterrupted availability cannot be guaranteed.

Access may occasionally be affected by:

Maintenance
Software updates
Hosting failures
Internet or network failures
Third-party outages
Cyber-security incidents
Circumstances outside our reasonable control

We will aim to minimise disruption where reasonably practicable.

22. Changes to Energy PUNK

We may modify the platform or individual courses where reasonably necessary to:

Improve the learning experience
Correct errors
Reflect technical developments
Respond to regulatory changes
Respond to standards changes
Improve security
Replace outdated material
Introduce new functionality

We will not deliberately remove a substantial part of a paid service in a way that leaves a learner receiving materially less than they reasonably contracted for without considering an appropriate remedy.

23. Membership price changes

Energy PUNK may change its membership price in the future.

Any price change affecting an existing member will be communicated before it takes effect.

A new price will not be applied retrospectively to a payment already made.

Where appropriate, members will be given an opportunity to cancel before a changed recurring price takes effect.

24. Suspension or termination by Energy PUNK

We may suspend or terminate access where there is reasonable evidence of:

Account sharing
Fraudulent payment activity
Serious misuse of the platform
Intellectual property infringement
Abusive conduct
Attempted unauthorised access
Repeated breach of these Terms
Unlawful activity

Where appropriate, we will normally contact you and provide an opportunity to resolve the issue before permanent termination.

Immediate suspension may be used where necessary to protect learners, our systems, our content or third parties.

25. Our responsibility to you

Nothing in these Terms excludes or restricts liability where it would be unlawful to do so.

Nothing in these Terms is intended to remove statutory consumer rights.

Energy PUNK is not responsible for losses arising solely because a learner:

Disregards current legislation or technical standards
Fails to follow manufacturer instructions
Undertakes work outside their competence
Incorrectly applies an educational example to a different real-world situation
Relies upon obsolete downloaded material after being made aware of an update
26. Third-party services

Energy PUNK may use third-party services to provide elements of the platform.

These may include services relating to:

29. Complaints

If you are unhappy with Energy PUNK or believe we have failed to provide something we agreed to provide, please contact:

info@energypunk.net

We will aim to acknowledge complaints promptly and deal with them fairly.

Where an externally approved or awarding-body programme is involved, additional complaints or appeals procedures may apply.

30. Events outside our reasonable control

We will not be responsible for delay or failure caused by events genuinely outside our reasonable control.

Where such an event materially affects the service, we will take reasonable steps to minimise disruption and communicate with affected learners.

31. If part of these Terms is invalid

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

32. No waiver

If we do not immediately enforce a provision of these Terms, this does not mean we have permanently waived our right to enforce it.

33. Governing law

Energy PUNK Ltd is registered in Scotland.

These Terms are governed by the applicable laws of Scotland, subject to any mandatory consumer rights you have under the law applying where you live.

Nothing in these Terms removes any legal rights you have as a consumer to bring proceedings in a court that applicable consumer law permits you to use.

34. Changes to these Terms

We may update these Terms where reasonably necessary, including to reflect:

Changes in law or regulation
Changes to Energy PUNK services
Changes in subscription requirements
New platform features
Security requirements
Clarification of existing terms

Where a change materially affects an existing paid membership, we will take reasonable steps to notify affected members before the change takes effect.
